Craft Software Company, LLC (“Craft” or “our” or “us” or “we“) respects your privacy and is committed to protecting it through compliance with this policy (“Policy“). This Policy describes the types of information we may collect or that you may provide when you access or use the Craft EMR (the “App“) and our practices for collecting, using, maintaining, protecting, and disclosing that information. This Policy does not apply to information that we collect offline or on any other Craft apps or websites, including websites you may access through this App or any information you provide to or is collected by third parties (see Third-Party Information Collection).
Our websites and apps, and these other third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.
Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use this App. By downloading, registering with, or using this App, you agree to this Policy. This Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this App after we revise this Policy means you accept those changes, so please check the Policy periodically for updates.
If you are using the App on behalf of an entity or an individual other than yourself, you represent that you are authorized by such entity or individual to act on their behalf and that such entity or individual acknowledges and agrees to the practices and policies outlined in this Policy.
You represent and warrant that, on behalf of yourself and/or the entity that you are accessing and using the App on behalf of, you shall not upload into the App, or otherwise provide us with, protected health information (“PHI“), as such term is defined under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, and its related regulations and amendments from time to time (collectively, “HIPAA“), without first having a Business Associate Agreement in place with us. You agree to defend, indemnify, and hold harmless Craft from any breach of the foregoing. Any information that does not constitute PHI may be used or disclosed in any manner permitted under this Policy.
The App is not intended for anyone under 18 years of age, and we do not knowingly collect personal information from anyone under 18. If we learn we have collected or received personal information from a user under the age of 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about anyone under the age of 18, please contact us at info@crafthealth.com.
We collect information from and about users or our App directly from you when you provide it to us and automatically when you use the App.
When you download, register with, or use this App, or otherwise provide information for use of the App, we may ask you to provide information by which you may be personally identified, such as name, email address, your date of birth, gender, address, and phone number (“personal information”). This information includes: (i) information that you provide by filling in forms in the App, registering to use the App, subscribing to our service including your account credentials, requesting further services, or reporting a problem with the App; (ii) records and copies of your correspondence (including email addresses and phone numbers), if you contact us; and (iii) details of transactions you carry out through the App.

In addition, we may use Google Analytics. Google Analytics is a web analytics tool that helps operators (like Craft) understand how users (like you) engage with their applications. Google Analytics uses cookies to track your interactions with our App and to collect information about how you use the App.
We then use the information to compile reports that help us improve the App. Google Analytics collects, processes, and creates reports about App trends without identifying individual users. When you use the App or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include: (i) advertisers, ad networks, and ad services; (ii) analytics companies; (iii) your mobile device manufacturer; or (iv) your mobile service provider. These third parties may use tracking technologies to collect information about you when you use this App. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. We use information that we collect about you or that you provide to us, including any personal information, to: (i) provide you with the App and its contents, and any other information, products, or services that you request from us; (ii) fulfill any other purpose for which you provide it; (iii) give you notices about your account/subscription, including expiration and renewal notices; (iv) carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; and (v) notify you when App updates are available, and of changes to any products or services we offer or provide though it. The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to: (A) estimate our audience size and usage patterns; (B) store information about your preferences, allowing us to customize our App according to your individual interests; (C) speed up your searches; and (D) recognize you when you use the App.
We may disclose aggregated information about our users, and information that does not identify any individual or device, without restriction. In addition, we may disclose personal information that we collect or you provide: (i) internally or to our subsidiaries and affiliates; (ii) to contractors, service providers, and other third parties we use to support our business including, but not limited to, third-party service providers that provide services such as the hosting of the App, data analysis, IT services and infrastructure, customer service, e-mail delivery, auditing, payment processing, and other similar services; (iii) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Craft’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Craft about our App users is among the assets transferred; (iv) to fulfill the purpose for which you provide it; (v) for any other purpose disclosed by us when you provide the information; (vi) with your consent; (vii) to comply with any court order, law, or legal process, including to respond to any government or regulatory request; (viii) to enforce our rights arising from any contracts entered into between you and us, including the Services Agreement entered into for you to access and use the App, and for billing and collection; (ix) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Craft, our customers, or others which includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction; (x) to investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (xi) investigate and defend ourselves against any third-party claims or allegations; and (xii) protect the security or integrity of the App. We may attempt to notify you about legal demands for your personal information when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may contact you about these matters via email at the address you provide to us and, by agreeing to this Policy, you agree to such notification being by email. We may dispute such demands when we believe, in our discretion, that the requests are unlawful, overbroad, vague, or lack proper authority, but we do not promise to challenge every demand.
We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website.

To make any of these requests concerning your personal information, please contact us a info@crafthealth.com. When contacting us, please indicate your name, address, email address, personally information in question, and what you wish to do with it. We ask that individuals making requests
identify themselves and identify the personal information requested to be accessed, corrected, or removed before we process any requests. We may decline to process requests if we cannot verify the requestor’s identity, the request may jeopardize the privacy of others, the change might violate any law or legal requirement, the change may cause the information to become incorrect, or for a similar legitimate purpose.
We endeavor to respond to a verifiable consumer request within thirty (30) days of receipt. If we require more time, we will inform you of the reason and extension period, along with the reason for the delay. We will deliver our written response by mail or electronically, at our option. Our response will also explain why we cannot comply with a request, if applicable. If we modify or delete some or all of your personal information, we will retain your personal information if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce obligations or fulfill any other requests from you (for example, to opt-out of further messages or for a copy of your personal information). You may appeal within 60 days if a request is denied. We may refuse a request based on its disproportionate cost, complexity, or frivolousness. In this event, you should send your appeal to info@crafthealth.com, referring to any interactions and requests you made of us regarding your personal information under this Policy.
We will inform you of any action taken or not taken in response to an appeal no later than sixty (60) days after we receive the appeal. If the appeal is ultimately denied, we will provide you with information regarding further rights you may have.
We will not discriminate against you for exercising your rights under applicable law or this Policy, nor do we charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide a cost estimate before completing your request.
The App may only be used as set forth in the Terms of Use. Disputes arising out of or relating to this Privacy Policy shall be instituted in the federal or state courts in each case located in Tulsa, Oklahoma.
This Policy does not address or apply to, and we are not responsible for, the privacy, information or other practices of any third parties, including, without limitation, the manufacturer of your mobile device, and any other third-party mobile application or website to which the App may contain a link. These third parties may at times gather information from or about you. We do not control and are not responsible for the privacy practices of these third parties. We encourage you to review the privacy policies of each website and application you visit and use.
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App.
To help protect the privacy of data you transmit through the App, where personal information is requested, we also use technology designed to encrypt the information that you input before it is sent to us using encryption technology. However, you should keep in mind that the App and our services are run on software, hardware, and networks, any component of which may, from time to time, require maintenance or experience problems or breaches of security beyond our control. We do not accept liability for unintentional disclosure. In addition, persons with access to your computer, phone, or other mobile or other devices may be able to access the App and information about you contained in the App.
By using the App or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the App. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the App or sending an e-mail to you. You may have a legal right to receive this notice in writing.
When using the App, you may choose not to provide us with certain information, but this may limit the features you are able to use or may prevent you from using the App all together. You may also choose to opt out of receiving certain communications (e.g., newsletters, promotions) by emailing us your preference. Please note that even if you opt out, we may still send you App-related communications. We do not currently respond to web browser “do not track” signals or other mechanisms that provide a method to opt out of the collection of information across the networks of websites and online services in which we participate. If we do so in the future, we will describe how we do so in this Policy. You may request that we provide you the personal information we hold about you, update your personal information, or ask us to remove your personal information, or to correct any inaccuracies in such personal information by sending an email to info@crafthealth.com with the subject heading “personal information request”. We will use reasonable efforts to deal with your request within a reasonable time.
Notwithstanding the foregoing, you understand and agree that the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide. If you have reason to believe that the security of your account has been compromised, please notify us immediately in accordance with the “Contact Us” section below.
We may update this Policy from time to time. If we make material changes to how we treat our users’ personal information, we will notify you by email to the email address specified in your account or through a notice on the App’s home page.
The date this Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
